Privacy Policy & Agreement

At SFXPCB, we are committed to protecting your privacy, engineering files, and intellectual property. This Privacy Policy & Agreement outlines how we protect your information and the responsibilities that apply when using our PCB manufacturing services.

1 Our Privacy Commitment

Our commitment to protecting customer information includes the following principles:

  • Protecting all data generated by and provided to us by our users from being stolen, compromised, or used in violation with this policy.
  • Never selling user-provided and user-generated data for financial gain or competitive advantage.
  • Providing transparency for our users into what data we collect and what we do with it including what access third parties have to user data and for what purpose.
  • Informing users if their data is compromised, either by failure to protect data or by order to surrender data to a legal authority, to the fullest extent we are lawfully able.

2 Restricted Products

For safety, legal compliance, and export regulations, SFXPCB does not manufacture certain products. We do not manufacture and don’t accept PCB products such as various weapons and equipment and military equipment.

3 ITAR / EAR Controlled

Customers are responsible for ensuring compliance with applicable export control regulations before submitting design files.

“International Traffic in Arms Regulations” which govern the export of weapons and weapons-related technology from the United States.

Please indicate whether your board design data is ITAR-controlled or not.

4 SFXPCB Content Policy

You represent and warrant that Your uploaded data (including PCB files, 3D CAD data and drawings), Your Order and/or the production, shipping, sale and use of the Parts or tooling by us doesn’t contain any weapons.

Prohibited Weapons

Weapons are broadly defined as the following categories.

Firearms

Firearms, firearm component parts, or ammunition.

This includes:

  • Any device which will or is designed to or may readily be converted to expel a projectile by the action of an explosive.
  • Any device capable of being concealed on the person from which a shot can be discharged through the energy of an explosive.
  • Any component part integral to the safe firing of a projectile by means of an explosive.
  • Ammunition including cartridge cases, primers, bullets, or propellent powder designed for use in any firearm.

Bladed Weapons

Bladed weapons.

This includes knives designed to cause bodily harm and any part or component thereof.

A bladed weapon includes:

  • Automatic knives
  • Knives that are undetectable by a metal detector
  • Stilettos
  • Switchblades
  • Butterfly knives
  • Throwing knives
  • Folding knives
  • Gravity knives
  • Disguised knives (for example, a sword cane)

Explosive Devices

This includes:

  • Grenades
  • Rockets
  • Explosives
  • Incendiary devices
  • Missiles
  • Land mines
  • Related parts or components

Toy Guns or Weapon Replicas

This includes:

  • Paintball guns
  • Airsoft guns
  • Training weapons
  • Mock guns
  • Mock weapons
  • Weapon replicas
  • Items that look like a gun or other weapon

Arms-related Items & Weapon Accessories

Accessories, parts or components to any weapon if that accessory, part, or component contributes to the functioning of the weapon and/or attaches to the item.

For example, this includes scopes, mounts and knife handles because they are attached to a weapon, but would not include a knife case or holster because they are neither attached to nor contribute to the functioning of the weapon.

5 Conflict-Free Minerals Statement

SFXPCB supports responsible sourcing and expects suppliers to comply with internationally recognized standards.

Conflict Metal means metals of gold (Au), tantalum (Ta), tungsten (W), cobalt (Co), tin (Sn) and so on are derived from or sourced from mines in conflict areas of the Democratic Republic of Congo (DRC), or illegally taxed on trade routes, either of which are controlled by non-governmental military groups, or unlawful military factions.

SFXPCB banned to use conflict metals and expects our suppliers to comply with the Electronic Industry Citizenship Coalition (EICC) Code of Conduct and to only source materials from environmentally and socially responsible suppliers and require all vendors purchase and use conflict-free metals, and priority source from smelters listed in EICC-GeSI Conflict-Free Smelter (CFS).

Therefore SFXPCB will commit to the sourcing of “Conflict Free Minerals” through our suppliers to comply with the regulations with Conflict minerals

6 Intellectual Property Rights and Publicity

This section explains how SFXPCB handles intellectual property, customer-provided design files, documentation, and the limited use of customer branding for promotional purposes.

Intellectual Property Rights

a) By providing data to SFXPCB, You grant SFXPCB an irrevocable, non-exclusive, perpetual, royalty-free, fully paid up, worldwide, transferable and sub-licensable right and license to use, copy, modify, reproduce, distribute and display the data (including PCB files, 3D CAD data and drawings), documentation, drawings and specifications You provide for manufacturing the Parts:

  • (i) as necessary to produce, ship and sell the Parts to You; and
  • (ii) to improve our products and services, including improving our machine learning and pricing algorithms.

You hereby irrevocably waive (and agree to cause to be waived) any claims and assertions of moral rights or attribution with respect to Your data.

Publicity

(b) By placing an Order, You authorize SFXPCB to use Your trademarks, logos, name or signs for marketing purposes.

This means that SFXPCB may mention You as a customer of SFXPCB on our website and in other promotional material such as:

  • Advertising
  • Press releases
  • Interviews
  • Promotional materials
  • Presentations

We will not use Your name if You are a natural person, and the substantive content provided by You continues to be governed by the confidentiality clauses in these Privacy Policy & Agreement.

7 Your Representations

By placing an order with SFXPCB, you acknowledge and represent that the following statements are true and applicable.

7.1 Authority to Enter into this Agreement

You represent and warrant that You have the right authority and capacity to enter into these General Terms of Sale (on behalf of Yourself or the entity that You represent) and that You are authorized to place an Order.

You represent and warrant that You are 18 years or older and are able to conclude legally binding agreements.

7.2 Ownership of Uploaded Data

You represent and warrant that You have the full right and authority to provide us with all data (including PCB files, 3D CAD data and drawings), documentation, drawings and specifications.

You further represent that:

  • All data You provide is accurate and truthful.
  • You are authorized to grant the license referred to in Section 1.

7.3 Compliance with Laws

You also represent and warrant that You will use Parts in strict accordance with all applicable state, federal and local laws and requirements.

7.4 Export Control Policy

You represent and warrant that You understand and agree with, including making the relevant certifications under, this SFXPCB Export Control Policy (“Export Control Policy”).

Export Controlled Data

You understand that SFXPCB does not accept Export Controlled Data.

“Export Controlled Data” is defined as data which is controlled for export under United States (“U.S.”) law.

This includes (technical) data and/or end Parts that are:

  • (1) Controlled under the International Traffic in Arms Regulations (ITAR); or
  • (2) Subject to the Export Administration Regulations (EAR) and controlled at any level beyond EAR99.

Customer Certification

You certify that Your data (including PCB files, 3D CAD data and drawings) and/or Your Order DOES NOT include Export Controlled Data.

International Data Transfer

You understand that by uploading Your data to the SFXPCB website, You are exporting data to another country.

SFXPCB maintains operations outside of the U.S., employs non-U.S. persons, and has non-U.S. manufacturing partners.

Export Classification Responsibility

You certify that You understand that it is Your responsibility to determine and provide the appropriate export classification for the products and related technology and software to be provided to SFXPCB and to comply with prohibition on Export Controlled Data provided herein.

3D Hubs relies entirely on You to provide accurate information for purposes of compliance with applicable export control laws.

The export classification indicates:

  • Whether the product and related technologies are controlled.
  • The relevant jurisdiction or jurisdictions.
  • When an export license is required.
  • Whether the product and technology qualify for a license exception.

An incorrect classification could result in export control violations, which could in turn lead to significant fines and other sanctions.

Compliance with Export Laws

You represent and warrant that the production, shipping, sale and use of the Parts or tooling by us in response to Your Order does not violate any export control laws or regulations.

Prohibited Export Activities

You represent and warrant that You will not, directly or indirectly:

  • (i) Sell, export, reexport, transfer, divert, or otherwise dispose of any products, software, or technology (including products derived from or based on such technology) received from SFXPCB to any destination, entity, or person prohibited by the laws or regulations of the U.S. and/or Your local jurisdiction.
  • (ii) Use Parts for any use prohibited by the laws or regulations of the U.S. and/or Your local jurisdiction without obtaining prior authorization from the competent government authorities as required by those laws and regulations.

Sanctions Compliance

You may not use SFXPCB’s services if You are the subject of U.S. sanctions or of sanctions consistent with U.S. law imposed by the governments of the country where You are using SFXPCB’s services.

8. Our Commitment

Fully acknowledging the fact that your personal information belongs to you, we do our best to securely store and carefully process the information you share with us.

In order to understand traffic to SFXPCB.com and diagnose technical problems, we log individual web requests.

We may retain these logs for up to 60 days, although individually identifying information will be obscured after one week.

We pass delivery addresses, phone numbers, and invoices to these companies to the extent required for:

  • Quoting shipping prices
  • Successful delivery of orders

16. Force Majeure

Certain events beyond our reasonable control may affect production or delivery schedules.

SFXPCB shall not be responsible for any delay or failure in delivery or performance of any of its duties under any Order due to events beyond its reasonable control or acts or omissions or any other occurrence commonly known as force majeure, including but not limited to:

  • War
  • Riots
  • Acts of terrorism
  • Acts of God
  • Pandemics
  • Natural disasters
  • Embargoes
  • Strikes
  • Other concerted acts of workers
  • Casualties or accidents
  • Failure by any SFXPCB manufacturing partner to meet their obligations
  • Any other causes or circumstances that prevent or hinder the manufacture or delivery of the Parts & PCB

SFXPCB may suspend performance under an Order for so long as such performance is delayed by such occurrence or cancel the Order at its sole discretion, in which case SFXPCB is not liable for any resulting damages.

17. Payment Providers

Payments made through SFXPCB are processed using secure third-party payment providers.

Payments for buying PCBs at SFXPCB.com are processed through PayPal.

When using PayPal on SFXPCB.com:

  • Users provide their PayPal email address.
  • Users are redirected to PayPal.com to complete payment.
  • Users are redirected back to SFXPCB.com after payment.

If you do not have a PayPal account, credit card data including:

  • Cardholder name
  • Credit card number
  • Expiration date
  • CVV
  • Full billing address

are sent to PayPal via an API for processing.

Details regarding orders are not sent to PayPal.

Each transaction is logged by retaining:

  • Transaction amount
  • Customer name
  • Addresses
  • Phone numbers

No credit card data is stored at any point on SFXPCB’s servers.

Your credit card information is immediately tokenized the first time it is processed.

Only the encrypted token is stored for future payments.

Data Disclosure, Storage, Transfer, and Processing

SFXPCB may process, transfer, or disclose personal data where required by applicable law or for legitimate business purposes.

18.1 Fulfilment of Legal Obligations
